The  Architects Act 1970, Act  35 of 1970  established  the South  African Council  for Architects  on  1 March  1971, and  this  legislation,  with  amendments,  remained  in  force  for almost 30 years. New legislation, the Architectural Profession Act 2000, Act 44 of 2000 was published on 1 December 2000 and came into operation on 26 January 2001. A Council, renamed The South African Council for the Architectural Profession (abbrev. SACAP) was established with effect from 12 September 2001.

A major change in the new legislation provided for the registration of Professional Architects, Senior Architectural Technologists, Architectural Technologists and Architectural Draughtsperson whereas the previous legislation had only recognised architects.

The new Council has the same main functions as the old, amongst other aspects:   its control of standards of education at Institutes of Technology and Universities (previously known as Technikon) for the purposes  of professional registration by means of visiting boards, the administration of a Code of Conduct in the public interest and protection of the public interest by identifying the type of architectural work each category of registered person is capable and competent to perform.

GOVERNMENT NOTICE 127 DATED 10 FEBRUARY 2006

 I, Stella N Sigcau, Minister of Public Works, under section 42(5) of the Architectural Profession Act, 2000 (Act No 44 of 2000) hereby determine 30 June 2006 as the date upon which any person practising as an architectural technologist or as an architectural draughtsperson and a candidate in any of these categories shall cease to be deemed to be a registered person

 In terms of section 18(2), a person may not after the above-mentioned date practise architecture in any of the categories contemplated in section 18(1) unless he or she is registered with the South African Council for the Architectural Profession in that category

2. SACAP PRESS RELEASE

                                                                                                                                 5 May 2006

Architectural Practitioners obliged to register with Architectural Council Professional Practice Exam required after 30 June 2006  

From 1 July 2006, all persons practising architecture or submitting architectural building plans to local authorities will be obliged to register with the South African Council for the Architectural Profession (SACAP) in one of the following categories:   

Professional Architect                                       -           PrArch

Professional Senior Architectural Technologist    -           PrSArchT

Professional Architectural Technologist              -           PrArchT

Professional Draughtsperson                             -           PrArchDraught

Under the transitional provisions of the Architectural Profession Act, 2000 (Act 44 of 2000), persons practising as Senior Architectural Technologists, Architectural Technologists and Draughtspersons were allowed to continue doing architectural work of under 500m² without being registered with SACAP until a cut-off date is determined by the Minister of Public Works in the Government Gazette

This date has now been determined as 30 June 2006 and published as Notice No 127 in Government Gazette No 28493 dated 10 February 2006. The main implication of this notice is that persons who apply for registration with SACAP after 30 June 2006 will have to pass a Professional Practice Examination before being able to register as a professional draughtsperson, architectural technologist or senior architectural technologist, as the case may be

Persons registered as candidates (trainees) in any of the above categories may undertake architectural work only if such work is performed under the direction, control and direct supervision of a person registered as a professional in a similar or higher category

Exemptions

Persons registered with certain closely allied Councils may be exempted if they, in the course of their profession, perform any overlapping functions for which their education and training have specifically rendered them competent

Identification of Work

An “Identification of Work Framework” which identifies areas of work to be performed by persons registered in each category of registration with SACAP, is still being finalised and should follow within a few months of the cut-off date of 30 June 2006. The present regulation which reserves architectural work of over 500 square meters for professional architects, remains in force until it is repealed by the Minister by notice in the Government Gazette and until the “Identification of Work Framework” is published in accordance with the Council for the Built Environment Act, 2000. After the publication of this notice, persons who are not registered with SACAP will not be able to perform architectural work and will be liable for prosecution if they continue to do so

Application forms for registration are available from the Council’s website at www.sacapsa.com or on request from 011 794 8333. Due to the large number of applications expected and the processing time required for each application, all applications for registration are to be submitted to SACAP as early as possible in order to help ensure minimal disruption to the architectural practices of those affected

3. IMPORTANT NOTICE TO ALL LOCAL AUTHORITIES

COMPULSORY REGISTRATION OF ARCHITECTURAL PROFESSIONALS : 30 JUNE 2006

Under the transitional provisions of the present legislation, persons practising as Senior Architectural Technologists, Architectural Technologists and Draughtspersons were allowed to continue practising without being registered with the South African Council for the Architectural Profession (SACAP) until a date determined by the Minister of Public Works in the Government Gazette  

The Minister has now determined 30 June 2006 as the date after which Senior Architectural Technologists, Architectural Technologists and Draughtspersons in private practice will be obliged to register with SACAP. The relevant notice (Notice No 127) was published in Government Gazette No. 28493 of 10 February 2006. Persons who apply for registration with SACAP after 30 June 2006 will have to pass a Professional Practice Examination before being able to register. Application forms for registration are available from the Council’s website at www.sacapsa.com or on request from 011 794 8333

In terms of section 26(3)(a) of the Architectural Profession Act, 2000 (Act No 4 of 2000), a person who is not registered in terms of this Act may not perform any architectural work. The Act currently makes provision for the following four categories of registration:

Professional Architect                                       -           PrArch

Professional Senior Architectural Technologist    -           PrSArchT

Professional Architectural Technologist              -           PrArchT

Professional Draughtsperson                             -           PrArchDraught

Persons registered as Candidates in any of the above categories will, after 30 June 2006, also not be able to undertake architectural work unless the work is performed under the direction, control and direct supervision of a person registered as a professional in a similar or higher category  

RESERVATION OF WORK

The “500 square meter rule” remains in force until it is repealed by the Minister by notice in the Government Gazette and until the Identification of Work proposals are published in accordance with Section 26(3) of the Act

As soon as the ‘Identification of Work’ proposals are finalised, the National Building Regulations will be amended in order to assist local authorities in applying the new rules in terms of the Architectural Profession Act

4. EXEMPTIONS.

                                                                                                                               26 April 2006

1.       The following persons may in the course of their profession perform any overlapping functions for which their education and training have specifically rendered them competent:

 Persons registered by the

 ·         Engineering Council of South Africa in terms of the Engineering Profession Act, No. 46 of 2000

·         South African Council for the Landscape Architectural Profession in terms of the Landscape Architectural Profession Act, No. 45 of 2000;

·         South African Council for the Property Valuers Profession in terms of the Property Valuers Profession Act, No. 47 of 2000;

·         South African Council for the Quantity Surveying Profession in terms of the Quantity Surveying Profession Act, No. 49 of 2000;

·         South African Council for the Project and Construction Management Profession terms of the Project and Construction Management Act No. 48 of 2000;

·         The South African Council for Planners in terms of the Planning Profession Act No. 36 of 2002

2.       The above also applies in respect of a person who is registered as a Candidate in terms of the above Acts: Provided that such work is performed in the service of or by order of and under the direction, control, supervision of or in association with a registered person entitled to perform the work identified and who must assume responsibility for any work so performed

3.       Until further notice by this Council, these provisions apply to Interior Architectural Designers in respect of the submission to local authorities of drawings and documentation related to the interior design of buildings

IS THE REGISTRATION BODY

  • Registration to the SACAP, in simple terms, will give you "a permit to practice" if you are in private practice. (if you are practicing in South Africa) 
  • As with engineers who unless they are registered with their council, they cannot work in private practice. The same apply with us in the architectural profession
  •  simply put:

o       anyone who is self employed

o       is in private practice

o       submits plans as ‘private jobs’

o       works for their own accord / account

Will need to be registered with the SACAP in order to submit plans to local authorities.

  • Anyone who is employed and works under a registered person and does not do work for their own accord, will not be required to be registered at this stage and may do so voluntarily.
